## SECTION 5 - INTERNATIONAL FULFILLMENT, SHIPMENT CONTRACT & PASSAGE OF TITLE
**5.1. International Direct-to-Consumer Fulfillment**
Klyvexo operates via international logistics and third-party manufacturing/fulfillment partners located outside the United States. We do not maintain physical retail storefronts, warehouses, or inventory storage facilities within the United States. All orders are dispatched directly from our international fulfillment centers outside the United States to the shipping address provided by you at checkout.
**5.2. Shipment Contract (FOB Origin) & Transfer of Title**
All purchases of physical items from Klyvexo are made pursuant to a **shipment contract** (Uniform Commercial Code § 2-319 / FOB Point of Origin outside the United States).
**You expressly agree that legal title to, ownership of, and technical risk of loss for all purchased items pass from Klyvexo to you immediately upon our delivery and tender of the goods to the international carrier at the point of origin outside the United States** (in accordance with Treas. Reg. § 1.861-7(c) and IRC § 862(a)(6)). The international carrier acts as your independent delivery agent for the transportation of the goods into the United States.
**5.3. Commercial Delivery Guarantee (Customer Support Protection)**
Notwithstanding the passage of legal title at the foreign point of origin set forth in Section 5.2, as a voluntary commercial courtesy under our Customer Satisfaction Program, if your package is verified by the carrier as lost in transit or arrives damaged, please contact us at **support@klyvexo.com** within seven (7) days of the expected or actual delivery date, and we will arrange a free replacement or refund in accordance with our Refund Policy.
**5.4. Shipping Estimates**
Delivery times provided on the Site are estimates only and commence from the date of shipping rather than the date of order. Delays caused by customs clearance, international air freight routing, or local postal operations (such as USPS, FedEx, UPS, or DHL) are outside our direct control.

## SECTION 6 - CUSTOMS, IMPORTATION & TAXES
Because goods are shipped directly from our international fulfillment facilities outside the United States to you as the end consumer, you are considered the "Importer of Record" for personal use under U.S. Customs and Border Protection regulations (including where applicable Section 321 *De Minimis* provisions).
Most personal orders under applicable U.S. customs thresholds enter duty-free. However, any applicable state sales taxes, use taxes, or import fees required by law are your responsibility unless explicitly collected at checkout.
